Armenia Launches New ICJ Case Against Azerbaijan

On 29 September, Armenia appealed to the UN International Court of Justice in The Hague to enforce Azerbaijan's compliance with the International Convention on the Elimination of All Forms of Racial Discrimination.

Yerevan demanded that Baku be obliged to refrain from any action aimed, directly or indirectly, at forcing the remaining ethnic Armenians out of Nagorno-Karabakh or preventing the safe and speedy return to their homes of those displaced by the recent military attack, including those who have fled to Armenia or third countries, and not to prevent those who wish to leave the region.

The Armenian side also demanded that the Azerbaijani military and law enforcement agencies leave all civilian facilities in Karabakh. "In addition, the Azerbaijani side should not obstruct the work of the UN and the International Committee of the Red Cross in the region. Azerbaijan should also immediately facilitate the restoration of gas and electricity supplies to Karabakh. In addition, Baku is obliged to refrain from taking punitive measures against Nagorno-Karabakh politicians and military personnel," the report added.

Azerbaijan's response

On the same day, the Azerbaijani Ministry of Foreign Affairs said that the new claims submitted by Armenia to the International Court of Justice to determine provisional measures in the case concerning the application of the International Convention on the Elimination of All Forms of Racial Discrimination (Armenia vs. Azerbaijan) are completely unfounded and absurd.

"These new claims aimed at inciting and promoting racial hatred against Azerbaijanis are completely unacceptable, ignoring the fact that Armenia has not given up its claims against the territorial integrity and sovereignty of Azerbaijan and the previous decision of the International Court of Justice on the mentioned case. Armenia is abusing the International Court of Justice and the UN Security Council for its insidious political agenda. This year alone, Armenia has appealed to this court for the third time. It should be noted that two of the three applications submitted by Armenia in January were rejected, one was granted in a limited form, and the applications submitted in May were unanimously rejected by the judges in July," the report added.

"The Azerbaijani side will submit its position to the relevant court, which will reflect Armenia's concrete answers to these new unfounded claims," the information concluded.
