Georgian President, Opposition, Government React to Court's Rule on Impeachment

On October 16, the Constitutional Court of Georgia found that President Salome Zourabichvili violated the constitution.

At the press conference to discuss the Constitutional Court's ruling on October 16, Tamar Chugoshvili and Maia Kopaleishvili, who defended President Zourabichvili in the impeachment process, said the ruling was political.

Tamar Chugoshvili claimed that although the Constitutional Court ruled with the ruling Georgian Dream party, the parliament failed to present evidence that the president was guilty of impeding Georgia's EU integration process. Chugoshvili continued, "We truly wanted the procedure to follow the law, but sadly, the court still chose to adopt a political stance."

According to Kopaleishvili, the Constitutional Court did not bother to differentiate even between the president's foreign policy powers as described in Article 52 and those outlined in other articles or whether the president has the authority to engage in basic foreign relations.

On the same day, Salome Zourabichvili said the court's decision hurt her but couldn't say she was surprised by everything in Georgia. According to Zourabichvili, she has no intentions of leaving or resigning. She emphasized that the judgment of the Constitutional Court was detrimental to the nation and that a nation cannot be deemed democratic if there is no balance between the various organs of government. The Georgian president stated that the Constitutional Court and each judge who signed it should be embarrassed by this ruling. "Today, they tried to kill the European future and democracy with one stone. This is the attempt of the [Georgian] Dream, but the time for dreaming 'dreams' is over. Let them think for themselves which Salome Zourabichvili was better for them. I am not interested in that, I am interested in where I will serve this country better, either as a free politician or as a president who will continue her mandate, the near future will tell," she added. Zourabichvili called on the opposition to take to the streets against this impeachment.

Irakli Kobakhidze, the chair of the Georgian Dream party, stated: "Zourabichvili has repeatedly, intentionally, and in clear violation of the Constitution of Georgia. With its ruling, the Georgian Constitutional Court also reaffirmed the obvious fact that, in accordance with its constitution, Georgia is a parliamentary republic where the only bodies authorized to establish and carry out the nation's internal and foreign policy are the Parliament and the Government. Salome Zourabichvili has compromised the Georgian constitution and the pledge she swore to uphold it." Moreover, Irakli Kobakhidze said the Parliament would vote on the impeachment of President Salome Zourabichvili this week.

Levan Bezhashvili from United National Movement noted, "We have repeatedly stated that the Constitutional Court is directly controlled by 'Georgian Dream,' the clan of the Court is staffed by their members, therefore there was no great expectation that the Constitutional Court would make an objective legal decision. [The members of the Constitutional Court] supported not the Constitution or the legal interpretation of constitutional norms, but unfortunately, they directly supported the claim of the 'Georgian Dream.' This once again confirms that the Constitutional Court no longer exists, there is no independent body that would make an objective, state decision on this or that important issue."

Paata Manjgaladze from Strategy Aghmashenebeli said: "The decision is an anti-Western action directed against the candidate status. If the Constitutional Court had said that the president had not violated the Constitution, the political impeachment of Irakli Kobakhidze would have begun because he had deceived the Government, the Parliament."
