UN Court Orders to End Nagorno-Karabakh Roadblock

On February 22, the International Court of Justice made a decision regarding the claims of Azerbaijan and Armenia against each other. 

The court's decision said Azerbaijan should use all available opportunities to restore unhindered traffic through the Lachin corridor. Judge Joan Donoghue announced the decision regarding Armenia's claim of temporary measures against Azerbaijan at the Hague Peace Palace. According to the verdict, Azerbaijan is committed to ensuring the unimpeded movement of people, vehicles, and goods through the Lachin Corridor in both directions until the final decision on the case is made, in accordance with its obligations under the International Convention on the Elimination of All Forms of Racial Discrimination. 

The International Court of Justice also made a decision regarding the claims brought by Azerbaijan against Armenia. Azerbaijan demanded that Armenia stop mining Azerbaijani territories and report the location of mines buried in previous years. The court said that taking temporary measures against Armenia regarding the burial of mines in the territories freed from occupation does not meet the requirements.

Notably, Azerbaijan and Armenia, which applied to the Hague court, accuse each other of violating the international convention "On the Elimination of All Forms of Racial Discrimination" (CERD).

Response from Armenia and Azerbaijan

Armenia's Foreign Ministry welcomed the decisions of the International Court of Justice of February 22 on the requests for provisional measures made by Armenia and Azerbaijan under the International Convention on the Elimination of All Forms of Racial Discrimination (CERD). "The Court has issued a legally binding order against Azerbaijan in the proceedings brought by Armenia against it while categorically rejecting Azerbaijan's requests made in the parallel proceedings Azerbaijan brought against Armenia," the ministry said.

The Azerbaijani Foreign Ministry reported, "We welcome the Court's recognition that Armenia is still under an obligation to refrain from aggravating the parties' dispute

, per the Court's prior order of December 7, 2021."

"Azerbaijan also welcomes the Court's rejection of Armenia's requested measures requiring Azerbaijan to cease its alleged "orchestration and support" of the protests and "immediately restore…the provision of natural gas and other public utilities" to Karabakh. In its Order, the Court noted Azerbaijan's representation that Azerbaijan has and undertakes to continue to take all steps within its power and at its disposal to guarantee safe movement along the Lachin Road and the terms of the Trilateral Statement of November 10, 2020." it added.
