
Georgian Parliament Moves to Ban Foreign Funding for Broadcasters

According to official drafts published on the Georgian Parliament’s website on February 24, members of the one-party legislature introduced amendments to the country’s broadcasting law aimed at banning foreign funding and imposing new regulations on broadcasters.
The draft law states: "Broadcasters are prohibited from receiving direct or indirect funding (money or other material benefits) from foreign entities," while allowing exceptions for commercial advertising, teleshopping, sponsorship, and product placement in programs. The explanatory note justifies these restrictions by arguing that broadcasters' content "could significantly influence the shaping of public opinion" and claims that the amendments would "help reduce the influence of foreign powers in shaping public opinion through broadcasters."
The amendments also prohibit foreign entities from purchasing services from broadcasters—except for commercial advertising and product placement—or financing the production or airing of their programs. The term "foreign entities" includes foreign governments, non-Georgian citizens, legal entities not registered in Georgia, as well as foreign-based foundations, associations, companies, networks, or unions operating under international law. Additionally, broadcasters would be barred from receiving "direct or indirect funding" in exchange for airing social advertisements.
Another significant aspect of the draft introduces restrictive regulations on broadcasting. Mamuka Mdinaradze, a leader of the ruling Georgian Dream party, previously claimed that the amendments would be modeled after British regulations. The new rules require broadcasters to "clearly distinguish fact from commentary" in news programs and prohibit them from covering public policy issues based on their "attitudes and opinions." The draft also mandates that news be reported with "reasonable accuracy" and in an "unbiased" manner, though it does not specify what these terms entail.
The proposed amendments grant individuals mentioned in a broadcast the right to "provide a timely and appropriate response." They also establish conditions under which secret recordings may be made, specifying that the subject must be of high public interest and that new evidence must be necessary. Additionally, the law sets standards for covering armed conflicts, disasters, and emergencies while expanding the Communications Commission’s authority to enforce laws, license conditions, and authorization rules.
